Grand Miramar Club and Spa WARNING...

Suckered by Grand Miramar sales
The first part of December we agreed to exchange our timeshare for Grand Miramar. After returning home, I tried to contact our sales person; no reply. I tried to use every contact number, etc. we were given; no way to contact. Finally a person in Loredo, TX replied and was agreeing to \"buy out our contract.\" Before that, however, I had contacted our credit card company because I suspected fraud. They are checking it out. Now I am getting no response from any of the contacts. This is a scam! Hopefully, my credit card company will be able to work with me on this. Puerto Vallarta is such a great place. Places like this bring disrespect to many people who work hard to keep people like this out! C. Doyle

Exchanging timeshares for Grand Mira Mar
What was the name of the company that is being used to help you get the money for your timeshare?
And what is the current status? Have you heard anything yet?
My parents did the same over 6 months ago and it only took 65-70 days to get thiers done.
Which timeshare are you trying to sell?
grand miramar
Did you ever get things back from the contract in Dec. I think we are now in the same boat. We signed left funds, and within 3 days went back, and they are finding ways not to retun our funds. Just interestred to see if you did get yours back and how much they charged for getting it back???
Grand Miramar another victim
Hello all,

Well I waited until the inventory manager emailed to inform me we could not get a refund on our deposit of over $12,000 before writing. WE signed on March 18th faxed in our cancellation on March 21st. confirmed fax. WE couriered our signatures from Canada on Monday March 22, with a confirmed receipt.
Grand Miramar is informing us we cannot cancel as we had signed a satisfactory letter. I guess I need to hire a lawyer now, another expense on top of all the phone calls to Mexico, courier, the stress of realizing we had been lied to.
They promised to sell three of our timeshares for $32,000. give us $8000 in rental income for 2010 and another five years. Which meant we would be making money. Now after reading this forum and talking to a few people I realize we were very gullible. If anyone has any other ideas please let me know. I have already contacted Profeco by email. And they have responded to my email asking me to work it out with Grand Miramar before they will get involved. Please ideas please!!
We really just want out of this situation. My understanding is if you cancel within 5 days they have to give back you money. I thought it was the law in Mexico. We do not want to deal with Grand Miramar from what I have heard from other purchasers is they did not sell their timeshare as promised and they have not received their rent as promised, we realize now we will have to come up with ANOTHER $32,000 as most likely the selling of our timeshares will not happen. thanks for replying so quickly.
well I sure wish I would have searched this website BEFORE being talked into attending the presentation.
does anyone know if Profeco really follows through with the federal law of the five business days to rescind?
You might try posting your questions on this website: http://tugbbs.com/forums/

It is a forum for timeshare owners.
What a mess! I hope you find a resolution to your problem soon. Did you ever contact Profeco? If so, what did they say?
Re: Also scammed by Grand Miramar!!!!
...I think it has left a very poor taste in my mouth of what PV is turning into. They sure were nice to us when we were there, however, I now think they are all in on it together and it is just a front for deceiving people and getting their monies.

We too have looked into our credit card company with complaints toward this company.

thank you ,
frustratedcanadian
The sales process for timeshare leaves much to be desired. However, it has nothing to do with PV. If you go on TUG, you will find misrepresentations in the sales process everywhere. It is an extreme case of \"buyer beware\" and is much worse in jurisdictions where there is no consumer protection.
We are still waiting for our timeshare \"SALE\" to be consumated. The Grand Miramar promised/guaranteed that Luxury Vallarta would pay us $15K for our timeshare in Whistler if we purchased the Grand Miramar. We were told that we would recieve our payment by February 2010... (signed papers in November 2009)... we made initial contact with Luxury Vallarta in November to find our what the needed... emailed and certified mailed it to them and then kept calling and emailing weekly, with no response for weeks. I think it was January before we finally found someone to talk to... they said they needed the whole Whistler contract... so again I sent that certified and via email... when we called the next time, they said they needed some release form, so again filled out that, mailed it and emailed it.... no one calls back... Next time we called (Max Martinez is his name) Max said we would receive it \"next week\".... then next time we called he \"would have to get back to us\" and so on and on... now it is April. We have done everything required of us, NO MONEY! We called Grand Miramar and they were trying to get us to make monthly payments for the $10K we owe them. The original deal was that we get paid from the sale of Whistler first, then we pay them the balance on Miramar. At this point, we will not pay another cent toward Grand Miramar... throwing good money after bad it would be for certain! Wish we had cancelled the deal at the start, I had a \"feeling\" but there was no bad press at that time (we looked) and they were great at keeping us busy the entire 3 day cancellation period. At this point we call them, they promise to call back...never do... both Miramar and Luxury Vallarta.... I wonder if it would be possible to file a class action suit against Luxury Vallarta?... not that they have any money to pay out >:-?
I am in PV and I would not offer to help because these guys never intended to buy your Whistler timeshare. This is a part of their scam. They will say anything to get you to commit. I have a friend who worked for a couple of months and quit because he said they demand that you lie and say yes to outrageous demands. Anything to make the sale.

We have another friend (a businessman from Wisconsin) who went to a TS pitch at the Mayan in Nuevo. He could not get a straight answer about what golf privileges came with the TS. He had purchased a fulltime unit beachfront at PDS Grande and made $400k on it so he was open to an investment to get some golf privileges. These guys talk in circles.
We found that Los Tules rented our unused time and did not reimburse us for it.
Do post back and let us know how things played out when you showed up in their office (hopefully with Profeco at your side).

As I posted before, the cost of a quick trip down there vs. what everyone is losing on these contracts would be well worth the price, IMHO.
I know Profeco in PV was operating out of a trailer for a while. I am not sure if they have moved into their new office or not. From what I have heard all complaints from Americans are handled out of their English speaking Mexico City office. The website below has a phone # listed in English that is a Mx. City number.

http://www.profeco.gob.mx/formas/f_3i_quejas.htm

If all else fails you could see about slipping a couple of those guys with the big guns some pesos to come with you, only kidding of course, but it would be fun to see the look on the faces of the people in the Sales Office.
Thanks!
Thanks! Will check it out...
Good luck to you! The Profeco office is located on a street called \"Francisco Villa\" in the Fluvial area (again close to the Costco). If you want to e-mail Profeco in PV, try this address profecovallartajalisco@hotmail.com. The Profeco phone number in PV is (322) 225-0000. The office is open Monday through Friday from 8:30am to 3:30pm.
Thanks again!
Thanks again for the good information. Today we made contact with our Bank of America \"billing dispute\" office and faxed all of our pertinent information to begin that process. I will email Profeco tomorrow...
Have any of you thought of writing a letter to the editor in the PV Tribune? I noticed in the latest edition there was a letter with a person complaining about an OPC from Mayan Palace in MEGA while this person was shopping. The person writing the letter outlined the entire experience and they printed it, so it might be worth a try. Whatever bad publicity you can throw their way will not be good for sales and alot of visitors read the english newspapers while they are visiting PV.
Great news! Glad to hear it finally worked out for you. One down and how many more to go?
That is good news!
Great news on the $13,000 returned. I think the combination of complaints, phone calls, emails, etc. is working. Claudia Ramirez is also working with us and has been good to respond when a refund/devolution has been posted. I had even sent the link to this site to them, so they could see what was being written about Grand Miramar.
Miramar Scam
Jangor,

Oh, just realized the credit card company sided with you, so a lawyer is not needed. That is great!!
Followed the adise fromcounsal2008 & got $ back
Just a note to thank counsal2008 for posting a solution to get your $ back.
We followed it on our resetn July 2010 trip and recieved refunds on two credit cards for a total of over $15K in less than a week.

However, we made the mistake of staying at the hotel one night and were charged $495 plus credit card fees, and a $100 dinner. The total was $1188 but we were happy to cancel.

They were certain that another hotel had coached us. Thanks again to all of you for taking the time to help others. Good luck!!
Whew!!
Just wanted to let you know that Miramar did not dispute our case and the 45 days are up for them to do anything now. Hope we have learned our lesson.

Grand Miramar Scam!!!!
I, too, purchased at GMiramar last March. I, however, could not find any discussion re scams with GM online and therefore did NOT cancel
.
I have had the same difficulties with the other company Luxury Vallarta - no response to any request for sale or rent of my other timeshares.

Although LV and GM are different companies, the agreement of the Luxury Vallarta to sell/rent my other timeshares was, I guess like everyone else, was what sealed the deal for me. Now this other company (LV) which the GM were representing has not fulfilled their contract. I am devastated and would appreciate any advice anyone could share with me.
Does anyone have the name, address, e-mail, etc of any person or office in PV that a person can complain to about Grand Miramar? Can articles be written to the local English newspaper to warn people about this organization? What can we do to help others avoid what we have done. Any ideas? Knowlton
There are four (4) pages on here of recommendations/different situations on here. People have given very detailed information on what they have done. Read through the entire thread and I think you will find your answers.
Grand Miramar Scam
I have also been duped out of a substantial amount of money from The Grand Miramar scam.

I have retained a very reputable lawyer who knows Mexican law and deals with timeshare scams quite regularly. He believes strongly that criminal charges should be laid against these individuals in order to get funds returned.

He has suggested that it would be beneficial to create a group of individuals to join together to share the costs of the action. This would be regardless of the amount of funds that you are looking to recover.

If you have an interest in helping to create a group, please contact me for further information.

I looking forward to hearing from you.

Grand Miramar Help wanted
We also bought into GM in May 2010 and the guarantee period for our timeshare sale has expired. GM does not reply to our calls or emails. Any suggestions are appreciated. Rasputin mentioned about the local Mexican Tourism office. Was that in the US or Mexico. If anyone has waiting this long, do you have any ideas to help. Thanks, JR
If you still need help: call the Chicago Mexico Tourism board, (312) 228-0517. Speak with Santiago Gomez or Rodrigo Esponda, the Director. Both are very polite and very professional and wish to protect the good name of Mexico. God Bless.
help for timeshare victims
Personnel in the Mexican Tourist Office are located both in the U.S. and Mexico. They are in the same office as Profeco in Puerto Vallarta and put pressure on Profeco to resolve your fraudulent purchase and also speak with Miramar to persuade Miramar to resolve your dispute. They do not have legal power to force a resolution. Profeco has the legal power.

See the website for the Mexican Tourist Office www.visitmexico.com and send your documents to the director for the area in which you live. Also send your documents to the office below.

Ripped off by Grand Miramar
 We bought (suckers) from Grand Miramar. We went to the presentation and the deal was too good to be true but seemed possible. We were told that it was partial ownership but were bait and switched. What the contract actually sells is a membership in a travel agency. Then they tell you that they will guarantee the sale of the time share you own now. However, the contracts that they give you are from two different companies. You will be buying from one company (World Luxury Destinations or some such) and the contract that sells your existing time share is another company (Continental Resources or some such). I could swear the contract I read said I was buying what the salesman was selling (Partial Ownership) but when his wife brought the contract by our hotel the next day I think she switched the contract for another that only included the travel agency and not the partial ownership of Grand Miramar. This is a good trick. He said he did not have the signed copy so she had to bring over a new copy.

They said they would buy our current timeshare at the Grand Mayan and that if they did not buy it before the end of sixty days we would be able to get our money back. We even have an addendum to that effect. However, the addendum is on Continental Resources letterhead. Continental says they are going to purchase our properties but never does anything about it. They keep saying that they need a release letter form World Luxury Dest. and that they can not do anything until they receive that letter. So I call Alberto at WLD and he says he has sent the letter. I just feel completely ripped off. I have spent hours on the phone to no avail.

Anyway, I have been trying to get them to honor the contract as it is and can get absolutely no resolution.
One other thing, has anyone stayed at any of the places Grand Miramar promises?

The company they bought from was Continental Resources which referred them to Eagle Marketing solutions. All of them are scammers.

The 1-800 number profeco has doesnt work, I will have to contact their mexican phone number.
